City Centre Unrest August 2011
In light of the disturbances that have taken place in a number of major city centres across the country over the past few days, We feel it important to issue you a directive which we hope may be helpful.

Provisions under the Riot Damages Act 1886
The current definition of a riot is codified in the Public Order Act 1986. The essential points are:
- 12 or more persons must be present together and use or threaten unlawful violence for a common purpose and the conduct of them (taken together) must be such as would cause a person of reasonable firmness present at the scene to fear for his personal safety
- It is not necessary for the Claimant to show intent to use force to resist such opposition
- It is not necessary for anyone to be present and actually harmed
The local police authority has a legal responsibility under the Riot Damages Act 1886 to reimburse persons who sustain damage to property as the result of a riot. The wording of the statute is explicit, in that any claim under the Act must “be made in writing and received by the local police authority within 14 days of the alleged incident.
However, policyholders are reminded that policy wordings include within the Claims Notification Clause, a requirement for any claim for riot and/or civil commotion to be notified to Insurers immediately with full supporting documentation within 7 days of the incident occurring, specifically to prevent a recovery action being turned down by the police authority on the basis that the action is time barred. The Insurance Company Ltd is then entitled to recover their outlays under the principle of subrogation.

New Year, new regulations
As we all return to work and absorb the changes and challenges that a New Year brings we should also be mindful of continuing changes within the regulatory world.
The final phase of the Energy Performance of Buildings Regulations (EPBR) came into force with effect from the 4th January 2011. These regulations were put in place in 2007 and have since been introduced in several phases. The regulations saw the introduction of Energy Performance Certificates.
The final phase, however, and one which will affect many businesses is the lowering of the size of air conditioning systems.
Effective from 4th January 2011, all air conditioning systems with a cooling or heating capacity of greater that 12 kW will require to be surveyed and reported upon. This is a reduced threshold from the previous 250 kW. Once complete the survey report and its findings will be applicable for 5 years. The survey will also be accompanied with a recommendation report which will identify ways in which to operate the systems more effectively and thus save on operating costs. Operating costs are of course in current times, uppermost in our minds.
This legal requirement to have the efficiency of air conditioning systems assessed fulfils part 4 of the EPBR, which also contribute to the Government’s strategy in meeting their climate change targets.
